1. About These Terms

These Terms & Conditions ("Terms") govern your use of the Pintash website located at pintash.com ("Site") and any purchases you make through it. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site. You must not:

 

• Use the Site in any way that violates applicable local, national, or international laws or regulations

• Attempt to gain unauthorized access to any part of the Site or its related systems

• Use automated tools to scrape, crawl, or extract data from the Site without written permission

• Reproduce, duplicate, or resell any part of the Site without express written consent from Pintash

3. Orders and Payment

Placing an order constitutes an offer to purchase a product at the listed price. We reserve the right to decline or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, or product unavailability.

Pricing is displayed in Canadian dollars (CAD) and is inclusive of applicable discounts. GST/HST is added at checkout for Canadian customers based on their province of delivery.

Payment is processed securely through Wix Payments. We do not store complete payment card information on our servers. By placing an order, you confirm that the payment information provided is accurate and that you are authorized to use the payment method.

Order confirmation does not constitute acceptance of your order - it confirms receipt. Acceptance occurs when your order is dispatched by the supplier.

 

4. Shipping and Delivery

All orders are fulfilled by third-party suppliers through Modalyst. Delivery timelines are estimates and are not guaranteed. Full details are set out in our Shipping Policy at pintash.com/shipping-policy.

Pintash is not liable for delays caused by carriers, customs authorities, or circumstances outside our control.

 

5. Returns and Refunds

Our return and refund terms are set out in our Refund Policy at pintash.com/refund-policy. By placing an order, you acknowledge and agree to those terms. Key points:

 

Return requests must be submitted within 14 days of delivery

Opened or used beauty and skincare products are non-returnable for hygiene reasons

Defective or incorrect items must be reported within 7 days of delivery with supporting photos

6. Intellectual Property

All content on this Site - including text, product descriptions, images, logos, and design - is owned by or licensed to Pintash and is protected by Canadian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Site content without prior written permission from Pintash.

 

Product images may be sourced from suppliers. Pintash makes reasonable efforts to ensure images are accurate but does not warrant that they are error-free.

We make every effort to ensure product descriptions, ingredients, pricing, and images are accurate. However, we do not warrant that product descriptions or other Site content is complete, reliable, current, or error-free.

Cosmetic products sold on this Site are intended for external use only. Always read the full ingredient list before use. Pintash is not responsible for allergic reactions or sensitivities - we recommend a patch test before first use of any new skincare product.

 

Product descriptions contain cosmetic claims only. No product on this Site is intended to diagnose, treat, cure, or prevent any disease or medical condition.

 

8. Limitation of Liability

To the fullest extent permitted by applicable law, Pintash and its operators shall not be liable for:

 

Any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products

Loss of profits, data, goodwill, or other intangible losses

Delays, errors, or failures caused by third-party suppliers, carriers, or payment processors

Any personal injury or adverse reaction resulting from misuse of a product or failure to follow product instructions

 

Our total liability to you for any claim arising from your use of the Site or a purchase shall not exceed the amount you paid for the relevant order.

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under Canadian law.

 

9. Disclaimer of Warranties

The Site and all products are provided "as is" without warranties of any kind, either express or implied, except as required by law. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.
